Robert J. (Tracy) Carson is a senior associate in the firm’s award-winning litigation group where he focuses his practice on complex commercial litigation.
Tracy has experience with business torts, including breach of contract and fraud, automotive products liability, insurance coverage and bad faith, construction, and personal injury litigation. He has also served as an attorney’s fees expert in state and federal court. Additionally, Tracy has experience in seeking and obtaining injunction relief to preserve assets pending litigation of his client’s claims.
Tracy received his J.D. from the University of Texas School of Law. He also received his BS with honors from UT Austin.
Obtained a temporary restraining order against an internet scammer and his fraudulent entity who had impersonated a food products wholesaler and duped a food processor into wiring money to the scammer’s bank account.
Obtained dismissal, on personal jurisdiction grounds, for a California digital picture frame manufacturer who was hailed into court in Florida after reporting an Amazon retailer for selling the manufacturer’s used frames on the seller’s Amazon storefront.
Obtained a $200K judgment, including damages and attorney’s fees, against an individual LLC member and his construction company for breach of contract.
Obtained an order awarding sanctions in a breach of contract case, to include repayment of all reasonable attorney’s fees and costs, against opposing counsel and his client in the Northern District of Texas, Dallas Division
Obtained summary judgment for an OEM in a vehicle fire and property damage case in the Northern District of Texas, Dallas Division
Represented a modular construction company in an insurance coverage and bad faith practices dispute in the Northern District of Texas, Dallas Division
Represented a reverse logistics company, and its majority shareholders and officers, in a $10 million fraud and corporate records dispute involving a stock purchase from a minority shareholder in Dallas County
Represented a commercial insurance agency in a $5 million insurance coverage and bad faith practices case involving a large property loss in Dallas County
Represented a collection of real estate financing funds in breach of contract and tortious interference disputes
