Merritt Westcott is a partner in the firm’s intellectual property group with 25 years of experience representing clients across diverse technologies and industries, with a particular focus on biotechnology. Merritt has extensive experience litigating high-stakes biotech patent disputes, including cases involving genetically engineered crops and food products, monoclonal antibodies, blood cell controls, clinical medical products and devices, and both traditional and biosimilar pharmaceuticals under the Hatch-Waxman Act and the Biologics Price Competition and Innovation Act (BPCIA). Her technical expertise is bolstered by her master’s degree in genetics and molecular biology, enabling her to provide a unique perspective in scientifically complex cases.
Merritt has also litigated many patent cases outside the biotech area, including cases relating to oil and gas exploration technology, mass storage systems, computer software, could-based CPaaS platforms, methods of food manufacturing and processing, geofencing technology, and building material designs.
In addition to her litigation practice, Merritt counsels clients on patent and intellectual property strategies, pre-suit investigations, due diligence, and freedom-to-operate analyses. She is also well-versed in proceedings before the Patent Trial and Appeal Board (PTAB).
