On Wednesday Nov. 6, 2024, the U.S. District Court for the District of Delaware entered a final judgment in favor of MWM client Galderma Labs and several other defendants in a long-running patent and trade secret dispute that had just about everything:

  • A 150-page complaint asserting 16 claims and seeking over $200 million.
  • Litigation that spanned four venues with substantive rulings by 10+ judges in California, Delaware, Texas, and at the PTAB.
  • Almost 50 fact witness depositions.
  • 16 designated experts.

In the end, in two orders entered one-year apart, Judge Gregory Williams granted summary judgment in favor of Galderma on all claims: no patent infringement, no theft of trade secrets, no breach of contract, no misappropriation of trade dress, no damages, and no violations of the Delaware DTPA or California unfair competition laws.

This outstanding win was achieved due to extraordinary effort by the MWM team led by Mike Wilson, including Jenny Martinez, Sarah Lopano, Chase Cobern, Charles Zerner, Tri Truong, Alex Jablonski, Rob McCutcheon, and Bill Munck.
